…The problem is that these faculty members did not
[BCSC Trial Transcript — Page 18]
write letters of support. They wrote letters of
attack against a student making a holy day
observance appeal. Further they were malicious
attacks, attacking my mental and emotional
stability and the very core of my religion. While
these particular faculty members are not the KKK,
the history — the act does not demand that they
have a well-known history of hate. It is the
intention of these faculty members to promote
hatred, contempt or inferiority-superiority that
is at issue, and for all of these defendants, it
is their measure for hatred that is clear in the
evidence.
Next, the CRPA, to my knowledge is unique in
its recognition that if the court awards damages
or exemplary damages in an action brought by a
member of a class of persons under section 2, the
court may order payment of the damages to any
person, organization or society that in the
court’s opinion represents the interests of the
class of persons. If the court sees fit to award
any damages in this matter, it is my position
that, in fact, any award be given to an
organization or society that in the court’s
opinion represents the interest of students and
perhaps and in particular students who are being
silenced on issues at university campuses based on
religion.
I just have to go back to my spot, because I
was out of order.
THE COURT: Ms. Maughan, we started a little bit late
this morning, but generally speaking we would take
a break around this time. Would that be a
convenient time for you to — to review it?
MS. MAUGHAN: Certainly. Yes, and I’ll just get my
spot back. Thanks. Yes.
THE COURT: All right. We’ll take 15 minutes.
THE CLERK: Order in court. Adjourned for a recess.
